How Overtime Pay Is Calculated
Federal (FLSA): Regular Pay = MIN(Total Hrs, 40) × Rate
OT Pay = MAX(0, Total Hrs − 40) × Rate × 1.5
California Daily: OT = Hours 8–12 per day × Rate × 1.5
DT = Hours over 12 per day × Rate × 2.0
OT Pay = MAX(0, Total Hrs − 40) × Rate × 1.5
California Daily: OT = Hours 8–12 per day × Rate × 1.5
DT = Hours over 12 per day × Rate × 2.0
Federal vs State Overtime Rules
- Federal FLSA: OT required for hours over 40/week. No daily OT requirement. Applies to most non-exempt employees.
- California: OT at 1.5× for daily hours 8–12 AND for weekly hours over 40. Double time (2×) for daily hours over 12, or for the 7th consecutive workday. Both daily AND weekly thresholds can apply in the same week.
- Alaska, Nevada, Colorado: Also have daily overtime rules. Check your state\'s department of labor for specifics.
- Exempt employees: Salaried employees who meet FLSA exemption criteria (executive, administrative, professional) are not entitled to overtime regardless of hours.
OT Rate Multipliers Explained
- 1.5× (Time and a half): The standard US overtime rate. At $20/hr, OT pays $30/hr.
- 2× (Double time): Required in California for daily hours over 12 and for the 7th consecutive workday. Some union contracts also specify double time.
- 1.25×: Occasionally seen in international contexts or certain specialized contracts.
Can my employer refuse to pay overtime? +
If you are a non-exempt employee under the FLSA, your employer must pay overtime for hours over 40 in a workweek. An employer can discipline you or even fire you for working unauthorized overtime — but they cannot refuse to pay you for hours actually worked. If you are owed unpaid overtime, you can file a complaint with the Department of Labor\'s Wage and Hour Division (WHD) at dol.gov, or consult an employment attorney.
What is the FLSA salary threshold for overtime exemption? +
As of 2024, employees earning less than $684/week ($35,568/year) cannot be classified as exempt from overtime, regardless of their job duties. Employees above this threshold may be exempt if they also meet the "duties test" for executive, administrative, or professional exemptions. The threshold was proposed to increase to $1,128/week in 2025, pending legal challenges.
